2. Purpose of this site
e-cruitnow is an applications service provider offering job seekers easy access to career opportunities. Our service enables you to obtain access to a number of third party sites provided by online internet recruiting services and therefore to a wider range of jobs and, to post your CV upon them through a single application at our site. We do not undertake that you will receive an offer of employment through your use of our service. We will however provide you with quick and easy enrolment on those third party sites you select, control of your personal information and security and confidentiality. Once your details have been forwarded to any third party, you will be bound by the terms and conditions of that third party, and it is your responsibility to ensure that you are familiar with these. e-cruitnow undertakes no responsibility to ensure that you are made aware of the terms and conditions of any third party to whom you or we forward your details.
3. User information
As a registered user of one-cv from e-cruitnow, you may provide information about your employment requirements for forwarding to third party sites. You may, for example, provide a copy of your curriculum vitae. In so doing, you agree to provide only information that it is lawful, complete, accurate and appropriate to the circumstances. In addition, e-cruitnow specifically prohibits the use of our service, and you agree not to submit any Material that:
Is defamatory, threatens or abuses others. Is racially or ethnically offensive. Is obscene, pornographic, vulgar or harmful to children. Infringes the copyright, trademark, trade secret or other intellectual property rights of others. Contains advertisements, promotions or commercial solicitations unrelated to the types of career opportunities offered through e-cruitnow. Contains viruses, corrupted files or any other similar software or programmes that may damage the operation of another's software. Deletes or revises any Material posted by any other person or entity.e-cruitnow acts as a passive conduit for the online distribution and publication of users submitted information and is under no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by you or other users.
If notified by a user of communications that do not conform to the foregoing restrictions, e-cruitnow may investigate the allegation and determine at good faith and at its sole discretion whether to remove or request the removal of the communication. e-cruitnow shall be under no liability or responsibility to you for performance and non-performance of such activities. e-cruitnow reserves the right to terminate this Agreement and prevent your further access to our service if the above terms and conditions are violated and the right to delete communications that are abusive, illegal or disruptive. e-cruitnow may take any action with regard to information submitted by you that it deems necessary or appropriate in its sole discretion if it believes that it may create liability for e-cruitnow [or may cause e-cruitnow to lose (in whole or in part) the services of its suppliers.
4. Restrictions on use
As a condition of your use of our service, you agree not to use it for any purpose that is unlawful or prohibited by this Agreement. With the exception of information provided by you, you may not copy, distribute, reproduce, republish, upload, post or transmit in any way any Material without the prior written consent of e-cruitnow. e-cruitnow authorises you to make use of a single copy of the Material solely for your personal, non-commercial use provided that you do not delete or change any copyright, trademark or other proprietary notice. Neither title nor intellectual property rights are transferred to you, but remain with e-cruitnow, who own full and complete title.
5. Limits on liability
e-cruitnow will not be liable for:
The contents of any communication, message, or information provided to e-cruitnow by you or other third parties. The contents of any website not controlled, owned, or operated by e-cruitnow that is accessed from or linked to this website by direct or indirect means. Any need for servicing or replacing equipment or data resulting from the use of the service, and in particular e-cruitnow does not warrant that the service will operate error free or that it is free of computer viruses or other harmful mechanisms. Any damage or injury to property caused by any failure in performance, error, omission, interruption, defect, delay in operation of transmission or line failure. Whether each user is who they are claimed to be, or any risks including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, under age persons or persons acting under false pretences. You assume all risks associated with dealing with other users with whom you come into contact through our service. The quality, safety or legality of the career opportunities or job vacancies, the truth of or accuracy of the listings, the ability of recruiters to offer job opportunities to job seekers or the ability of job seekers to fill job openings. Any claims, demands or damages (actual and consequential, direct and indirect) of every kind and nature arising out of or in any way connected with any dispute between you and any other user of our service. Any inaccuracies or typographical errors. The content, form and accuracy of any job description placed by you. Any employment decisions for whatever reason made by you posting jobs on any job board accessed through e-cruitnow.e-cruitnow makes no representations about the accuracy, reliability, completeness or time limits of the service or the Material. The use of the service and the Material is at your own risk. Changes are periodically made to the service and may be made at any time. If you are dissatisfied with any portion of this service or with any of these terms of service your sole and exclusive remedy is to discontinue using this service and terminate your involvement by sending an e-mail to unsubscribe@e-cruitnow.com with 'unsubscribe' in the subject line.]
6. Downtime
This service will be accessible for 24 hours a day 365 days per annum (366 days during a leap year) but you acknowledge that e-cruitnow will take the service offline for short periods from time to time to enable the completing of maintenance and that the service may otherwise, from time to time, not be available due to technical problems in the equipment
7. Career opportunity disclaimer
Third party sites and independent employers provide the career and employer information provided to you via this service. e-cruitnow is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of material on such third party sites. Moreover, e-cruitnow does not by its reference or inclusion of such hyperlinks to third party sites imply its endorsement or recommendation of any career opportunity or recruiter. If you decide to access linked third party sites you do so at your own risk. e-cruitnow neither represents nor warrants that you will successfully gain a new job as a result of your use of the information, services or software accessed through this service.
8. Disclaimer of warranties
The Material is provided 'as is' and without warranties of any kind either expressed or implied, to the fullest extent permissible pursuant to applicable law, e-cruitnow disclaims all warranties or merchantability and fitness for a particular purpose. e-cruitnow does not warrant that the functions contained in the Material will be uninterrupted or error free, that defects will be corrected, or that this service or the server that makes it available are free of viruses or other harmful components. e-cruitnow does not warrant or make any representations regarding the use of or the result of the use of the Material in terms of their correctness, accuracy, reliability, timeliness, or otherwise.
Use of this service, including but not limited to the submission of information about you to this service, is at your exclusive risk, and the risk of injury from the foregoing rests exclusively with you.
9. Indemnification
You agree to indemnify and hold harmless e-cruitnow, its directors, officers, employees, agents and representatives from and against all claims, liabilities, damages, and expenses (including legal fees and expenses) arising out of or relating to your use of this service (other than a breach by e-cruitnow) or any alleged breach by you of this agreement. 10. Jurisdiction
This Agreement shall be governed by the laws of England and Wales.
This service is owned and operated by e-cruitnow of Swan House, The Park, Market Bosworth, Warwickshire CV13 0LJ. e-cruitnow make no representations that the Materials in this service are appropriate or available for use in other locations. If you access this service from other locations you do so on your own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.
If any provision of these terms and conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions that remain in full force and effect. No waiver of any of these terms and conditions shall be deemed a further or continuing waiver of such term or any other terms.
11. Privacy policy
e-cruitnow wants to make your experience on line rewarding and safe. Our data collection policies allow you to choose how much information to provide to us, and to control how we use that information and to which third party site(s) it is transferred.
e-cruitnow will never wilfully disclose individual identifiable information about you without first receiving your permission. Other companies that place advertising on our site may collect information about you when you view or click on their advertising or contents. e-cruitnow does not control this collection of information and you should contact these advertisers or content providers directly if you have any questions about their use of this information. At all times you have total control over the accuracy of the personally identifiable information that you provide to e-cruitnow. If you have provided personal information to e-cruitnow which has been forwarded to a third party website, e-cruitnow will not be able to correct or update your personal information in this instance, although we will be able to correct or update your personal information before forwarding it to further third party websites.
12. Miscellaneous
This Agreement constitutes the entire agreement between the parties and supersedes all prior written or oral agreements or communications with respect to the subject matter herein. Sections 4, 5, 6, 7, 8, 9, 11 and 12 of these Terms and Conditions shall survive any termination or cancellation of this Agreement.
